Q. Does the policy cover Bodily Injury and Property Damage?
A. YES, both bodily injury and property damage arising out of a negligent act, error or omission in the rendering or failure to render professional services as described on the "DEC" page of the policy is covered.


Q. Are Claim Expenses inside the Policy Limit?
A. YES, claim expenses are within the policy limit.


Q. What is the Policy Territory?
A. The policy coverage territory is the USA(including territories and possessions), Puerto Rico and Canada. There is Global coverage if it is determined it is the Insured's responsibility to pay damages resulting from a suit in the USA, it's territories and possessions, Puerto Rico or Canada.


Q. Is a Discovery Period available?
A. YES, a one-year discovery period is available at the option of the insured for all Miscellaneous E & O policies we write. The discovery must be exercised within 30 days of the expiration date of the policy. Longer discovery may be available, but it is not at the option of the insured. The underwriter will determine this.


Q. Is General Liability Insurance available?
A. YES, we write Claims-Made General Liability Insurance in conjunction with most classes of Miscellaneous E & O Insurance, but NOT ALL CLASSES. It is the underwriters decision whether to write GL or not, and to determine what the premium will be. We DO NOT write GL alone, it must be included on the Miscellaneous E & O policy. (i.e. A package policy)


Q. Is the Policy Claims Made or Occurrence?
A. We write claims made policies ONLY for both E & O and General Liability.


Q. Do we write Unlimited Prior Acts?
A. NO, we do not write unlimited prior acts. All policies will have a retroactive date.


Q. Can a Retroactive Date be backdated?
A. NO, we do not backdate retroactive dates, if there was no prior coverage or the previous coverage lapsed, the retroactive date will be the inception date of the coverage.


Q. Do we pick up Prior Acts from another carrier?
A. MAYBE. We are willing to pick up prior acts from another carrier if coverage has been continuous and is still in force. The premium will be increased for this situation. However, if the previous coverage was significantly different from our coverage, we generally are not willing to quote prior acts and will decline the risk. We generally are not willing to quote shorter prior acts than the retroactive date the insured had on their previous policy.


Q. Can we write a risk excess of another insurer?
A. YES, but we generally write excess only on Miscellaneous E & O classes of business we normally underwrite. See the classes we write on the Miscellaneous E & O web page.


Q. Do we write Miscellaneous E & O Insurance on an Admitted basis?
A. NO, we only write on a non-admitted basis for Miscellaneous E & O Insurance.


Q. Do we cover Copyright/Trademark or Patent infringement?
A. NO.


Q. Do we cover Punitive Damages?
A. NO.
